1810 The Last Will of Daniel Thomas
In the name of God Amen. I Daniel Thomas of the county of Richmond and state of North Carolina planter. Being in an imperfect state of health and the time of life uncertain yet firm in mind and judgement, do this 23rd day of October 1809 make this my last will and testament in the manner and form following-
In primis I give and devise to my son William Thomas his heirs and assigns forever my now dwelling plantation with all my land thereunto joining. Item I leave all the above land and plantation wholly to my wife Sarah Tomas with my goods and chattels during her natural life. Item I give and devise to my son Elijah Thomas ten shillings. Item I also give and devise to my son Daniel ten shillings. Item I also give and devise to my son Henry Thomas ten shillings. Item I give and bequeath to my son John Thomas, twenty five dollars which money he has received in loan before the date of this will. Item I give and bequeath to my daughter Rebecca Blewitt one cow and calf. Item I give and bequeath to my daughter Susannah Thomas two cows and calves one bed and furniture and seventy five dollars. Item I give and devise to my daughter Sarah Thomas one bed and furniture. Item I give and bequeath to my son Benjamin Thomas one hundred dollars. Item I give and bequeath to my son Robert Thomas four hundred dollars. The above legacies left to my sons Benjamin and Robert is to be raised out of the price of the land left to my son William. And lastly, I ordain my sons Daniel and William Thomas Executors of this my last will and testament revoking and making void all other wills by me heretofore made. In witness whereof I have hereunto set my hand and seal the day and date above written signed sealed and delivered in the presence of us- Daniel Thomas (seal) who are subscribing witnesses in the presence of the testator and at his request. Testator Simon Thomas (his mark) Priscilla Thomas (her mark). James Thomas. Whereas there is no mention made of the moveable property of my estate in this my last will and testament it is therefore my will that after the decease of my wife my son William shall have all the property after a due division made agreeable to the above will and testament witness my hand and seal this the 23rd day of October 1809. Richmond County ____ Sep 1810 then the within last will and testament of Daniel Thomas Sen. was duly proven by the oath of James Thomas ordered to be recorded. William P Leak Clerk.
